Financial and Trading Risk Disclosure
1. Scope of Risk Disclosure
This Financial and Trading Risk Disclosure ("Risk Disclosure") informs users of the substantial financial, operational, and regulatory risks associated with peer-to-peer (P2P) foreign currency exchange involving the Egyptian Pound (EGP), Nigerian Naira (NGN), and West African CFA Franc (XOF).
You must carefully evaluate whether exchanging foreign currencies is appropriate in light of your personal financial situation, risk tolerance, and understanding of cross-border payment mechanics.
2. Foreign Exchange (FX) Volatility Risk
Foreign exchange rates for African currencies—in particular the Egyptian Pound and Nigerian Naira—are subject to extreme volatility driven by macroeconomic factors, central bank interest rate policies, balance-of-payments shifts, inflation, and parallel market liquidity conditions.
Rates may fluctuate dramatically within minutes. While Paytali locks the exchange rate permanently at the moment of order matching (MATCHED), the market value of the currency received may change substantially before or immediately following order settlement.
3. External Payment Rail & Banking Systemic Risk
Paytali does not own, operate, or custody funds transferred across third-party commercial banking networks or telecom mobile money systems. Transactions rely upon external payment infrastructure, including:
- The Central Bank of Egypt's Instant Payment Network (InstaPay / IPN);
- Egyptian Mobile Network Operator wallets (Vodafone Cash, Orange Money, Etisalat Cash);
- The Nigeria Inter-Bank Settlement System (NIBSS Instant Payment - NIP);
- Francophone West African mobile money networks (Wave, Orange Money, MTN MoMo).
These external networks may experience scheduled maintenance, unplanned system outages, network congestion, or delayed transaction settlement. Paytali is not liable for financial losses, delayed disbursements, or exchange rate slippage resulting from third-party banking or telecom failures.
4. Counterparty Risk & Escrow Collateral Limitations
While Paytali significantly mitigates counterparty default risk by requiring all merchants to lock 100% cash collateral in an append-only recourse escrow vault, counterparty risk cannot be entirely eliminated.
A merchant may experience localized liquidity shortages, commercial bank transfer daily limits, or delayed communication. In the event of confirmed merchant non-performance, recourse execution against merchant collateral is subject to the dispute investigation procedures and timelines outlined in the Dispute Resolution Policy.
5. Regulatory & Compliance Risk
Cross-border currency exchanges operate within evolving statutory and regulatory frameworks in Egypt, Nigeria, and West Africa. Government bodies (including the Central Bank of Egypt [CBE] and Central Bank of Nigeria [CBN]) may enact foreign exchange directives, capital controls, transaction reporting mandates, or limit cash-out operations.
Users are solely responsible for ensuring that their exchange activities comply with all applicable foreign exchange, tax, and reporting obligations in their country of residence, nationality, and physical location.
